Tourism and Events Queensland keeps its Privacy Policy under regular review and places any updates on this website.

If you do not agree with this Policy, do not access or use our services or interact with any other aspect of Tourism and Events Queensland.

Scope

Tourism and Events Queensland is the Queensland Government agency responsible for attracting both domestic and international visitors to Queensland. Internationally, Tourism and Events Queensland is active in approximately 14 key markets and undertakes activities including advertising, PR and media programs, trade shows and industry programs, consumer promotions, online communications and consumer research in those markets.

Your privacy

Tourism and Events Queensland is committed to protecting user privacy. We understand and appreciate that visitors and users of this website are concerned about their privacy and the confidentiality and security of any information that may be provided.

Tourism and Events Queensland understands the importance of being transparent about how we collect, use, and share information about you, and demonstrates this by complying with the Information Privacy Act 2009 (Qld) (Information Privacy Act) (including the Information Privacy Principles (IPPs) set out in this Act, the Spam Act 2003 (Cth) and other applicable privacy and data protection laws such as the European Union General and Data Protection Regulations (GDPR).

With regard to GDPR, it applies to the data processing activities of Tourism and Events Queensland in the European Union as we have operations in the European Union.  Tourism and Events Queensland offers goods and services or monitors the data behaviour of individuals in the European Union – via our websites and representative offices. Tourism and Events Queensland promotes Queensland as a tourism destination and also holds roadshows and ‘famils’ in the European Union.  As such, we have provided more detail around what we do with your data, and how you can have access to your privacy rights, and about the purposes for which we use your personal information.

1. WHAT INFORMATION TOURISM AND EVENTS QUEENSLAND COLLECTS ABOUT YOU

The types of information that Tourism and Events collects will depend on the nature of your dealings with Tourism and Events Queensland and may include:

  • your name, address, location and other contact details;
  • your date of birth and age;
  • your gender;
  • information about your nationality and language;
  • information about your interests, preferences, or travel plans;
  • information about our events (i.e. which events you attend and how you participate in our events);
  • where you choose to disclose via social media, your preferences, likes and dislikes; and
  • for those participating in a Tourism and Events Queensland Experience Program; driver’s licence or passport details, payment card details, food/health restrictions, fitness level, height and weight (used to ensure certain activities can safely be undertaken).

Tourism and Events Queensland will ensure that any personal information collected is relevant to Tourism and Event Queensland’s purpose (as detailed in Section 3 below), is accurate, complete and up to date. 

Where it is practicable, you may choose to remain anonymous or adopt a pseudonym when dealing with Tourism and Events Queensland. However, if you don't provide us with your personal information when requested, we may not be able to provide you with the information, or assistance that you are seeking.

2. HOW TOURISM AND EVENTS QUEENSLAND COLLECTS INFORMATION ABOUT YOU

Tourism and Events Queensland only collects your information for a lawful purpose which is reasonably necessary for or directly related to its functions under the Tourism and Events Queensland Act 2012 (Qld). Tourism and Events Queensland will only collect personal information by lawful and fair means.

Tourism and Events Queensland conducts a large part of its operations over the internet and via email. As part of its functions, Tourism and Events Queensland conducts market research surveys, offers access to publications, provides avenues for the booking of holidays or facilities, provides opportunities for tourism operators to market and promote their services, distributes industry based publications, conducts competitions and collects information on the types of holidays or events that you, the consumer, would like to see more of in the future so that we can help the Queensland tourism industry grow.

We collect information about you when you provide it to us when you use our services, and when other sources provide it to us, as further described below.

Tourism and Events Queensland Websites and Social Media

We collect content that you submit to these websites, which include social media or social networking websites operated by us. For example, you provide content to us when you:

  • subscribe to an email program/e-newsletter or register to receive brochures (e.g. through a Tourism and Events Queensland website) (see Email Programs/E-newsletters section below for more information);
  • apply to attend or exhibit at a Tourism and Events Queensland event;
  • enter a promotion or competition, including at a Tourism and Events Queensland event or through a Tourism and Events Queensland website;
  • agree to participate in a Tourism and Events Queensland Experience Program;
  • have business dealings with us.

If you use Tourism and Events Queensland’s websites (including queensland.com, teq.queensland.com/) information is recorded (via cookies) about your visit for web personalisation, research and statistical and reporting purposes as well as to allow Tourism and Events Queensland to improve its websites and services. See Cookies and Other Tracking Technologies section below for more information. 

When you visit a Tourism and Events Queensland website, our server makes a record of your visit and logs certain information for statistical and promotional purposes. No attempt is or will be made to identify users except in the unlikely event of an investigation where a law enforcement agency may exercise a power to inspect activity logs. The statistics and log files may be preserved indefinitely and used at any time and in any way necessary to prevent security breaches and to ensure the integrity of the information supplied by Tourism and Events Queensland. 

Email Programs/E-newsletters

As noted above, you are given the opportunity to subscribe to Tourism and Events Queensland email programs via the Tourism and Events Queensland website(s). For EU residents, the lawful basis for Tourism and Events Queensland processing your personal data is the explicit consent you provide to receive this content.

Tourism and Events Queensland informs its customers and business partners regularly by means of an e-newsletter. The e-newsletter may only be received by you if (1) you have a valid email address and (2) you register for the e-newsletter. A confirmation email will be sent to your nominated email after registration; this is a double opt-in procedure. This confirmation email is used to prove that the owner of the email address has in fact consented to receive the e-newsletter.

During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider and used by you at the time of the registration, as well as the date and time of the registration. The data may be required at a later date should Tourism and Events Queensland become aware of the possible misuse of an email address.

The personal data collected as part of a registration for the e-newsletter will be used to personalise our e-newsletter. In addition, the data will be used to personalise the user experience on Tourism and Events Queensland websites, and in our advertising programs. The subscription to our e-newsletter may be terminated by you subject at any time by using the ‘Unsubscribe’ link found in the relevant Tourism and Events Queensland email. Your consent to the storage of personal information, which you have given for receiving the newsletter, may be revoked at any time (again by using the ‘Unsubscribe’ link found in the Tourism and Events Queensland email).

Our e-newsletters contain tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, Tourism and  Events Queensland may see if and when an email was opened by you, and which links in the email you clicked on.

Such personal data collected in the tracking pixels contained in the e-newsletters are stored and analysed by Tourism and Events Queensland in order to optimise the e-newsletter, as well as to better adapt the content of future newsletters to your interests.

Payment information

We may collect payment information when you participate in a Tourism and Events Queensland Experience Program in order to arrange agreed goods and services on your behalf.

Business dealings

If you deal with Tourism and Events Queensland in the course of business, we will generally collect only your business contact details which we use to communicate with you for normal business purposes (whether as job applicant, as an employee of one of Tourism and Events Queensland’s external service providers, if you work for a government agency Tourism and Events Queensland deals with, in the context of a transaction, or if you volunteer personal information to Tourism and Events Queensland).

Enquiries and complaints

When you make an enquiry or complaint with Tourism and Events Queensland including by phone, letter, email, face-to-face or online, Tourism and Events Queensland will generally collect your name, address or email address and details about the complaint.

Employee information

Tourism and Events Queensland also collects personal information about its employees (including job applicants) and contractors (personnel records).

Interest-based advertising

Anonymous data from advertising cookies including browsing history and practices may be provided to third parties for the purposes of promoting tourism in Queensland via online advertising.

Although Tourism and Events Queensland has relationships with other suppliers, we select those relationships very carefully and constantly monitor them. These suppliers may also set their own cookies during your visit to show you products or services based on what you seem to be looking for.

3. HOW TOURISM AND EVENTS QUEENSLAND USES INFORMATION ABOUT YOU

Tourism and Events Queensland will only use and disclose personal information for the purpose for which it was collected, or otherwise in accordance with the applicable privacy and data protection laws and regulations.

Purposes for which we may collect, hold, use and disclose personal information are set out below:

  • providing information, news, offers and conducting surveys;
  • providing or facilitating the provision of goods and services;
  • facilitating the delivery of a Tourism and Events Queensland Experience Program;
  • engaging volunteers;
  • registering subscriptions to our email program;
  • running or managing events;
  • running a competition or promotion;
  • communicating with respondents to a call for expressions of interest or participation in relation to our events;
  • maintaining our relationship with an individual or entity delivering goods and services;
  • promoting ourselves and our products and services, including through direct marketing and events;
  • performing research and statistical analysis, including facilitating research by third parties and for service improvement purposes;
  • reporting statistics (on an aggregated, de-identified basis) to the government departments that fund us and to our promotional partners;
  • answering queries and resolving complaints (including responding to comments or messages submitted to us via our website);
  • sending individuals follow-ups on events, products or services inquired about;
  • keeping individuals informed of changes to this website and the events, products or services offered through this website or other sites of related companies, licensees or other production companies with which we collaborate; and
  • analysing the results of surveys.

We may use your personal information to let you know about our products or services, either where we have your express or implied consent or where we are otherwise permitted by law to do so.  We may contact you for these purposes in a variety of ways, including by mail, email, SMS or telephone. Where you have consented to receiving marketing communications from us, your consent will remain current until you advise us otherwise. However, you can opt out at any time, by:

  • contacting us as set out in Section 8; or
  • using the unsubscribe facility that we include in our commercial electronic messages (such as emails and SMS) to opt out of receiving those messages.

4. WHO TOURISM AND EVENTS QUEENSLAND DISCLOSES YOUR INFORMATION TO

We may disclose your personal information to third parties where appropriate for the purposes described above, including to:

  • information technology and data storage providers;
  • partner or affiliated organisations (including regional/local tourism organisations);
  • state and territory tourism authorities in the course of conducting trade events;
  • Queensland ministers;
  • Government departments that fund Tourism and Events Queensland;
  • research and statistical analysis providers;
  • publishing houses and marketing/advertising agencies;
  • business partners with whom Tourism and Events Queensland has a formal contractual relationship.

If Tourism and Events Queensland obtains your consent, personal information about you may be disclosed to organisations involved in the Australian tourism industry such as airlines, hotels, tour operators and product suppliers.

Tourism and Events Queensland will not use or disclose personal information for a purpose other than that for which it was collected unless:

  • your consent is obtained;
  • Tourism and Events Queensland is required to, or authorised by the law or a court or tribunal order; or,
  • otherwise in accordance with the applicable privacy and data protection laws.

To the extent permitted under the law, Tourism and Events Queensland may also use or disclose your personal information for a secondary purpose related to, or directly related to, the purpose of collection where you would reasonably expect that your information would be used for this other purpose. These secondary purposes may include activities such as public education or quality assurance.

5. HOW TOURISM AND EVENTS QUEENSLAND TRANSFERS INFORMATION WE COLLECT INTERNATIONALLY

Tourism and Events Queensland may disclose your personal information outside of Australia as part of its marketing functions. Countries in which recipients are likely to be located include those where Tourism and Events Queensland has regional offices located including China, Germany, Hong Kong, India, Japan, New Zealand, Singapore, South Korea, Taiwan, United Kingdom and the United States.

Tourism and Events Queensland will not disclose your personal information to any recipient outside of Australia unless one of the following applies:

  • The recipient is subject to a law or binding scheme substantially similar to the Information Privacy Principles, including mechanisms for enforcement.
  • You have consented to the disclosure after being expressly informed that Tourism and Events Queensland will not be taking reasonable steps to ensure that the overseas recipient does not breach the applicable privacy and data protection laws.
  • It is required or authorised by law.
  • It is required or authorised by an international agreement relating to information sharing to which Australia is a party.
  • It is reasonably necessary for an enforcement related activity conducted by, or on behalf of, an enforcement body and the recipient performs similar functions.
  • An exception applies under the law.

For EU residents

The hosting facilities for Tourism and Event Queensland’s EU websites are situated in Sydney, Australia.

Given that Tourism and Events Queensland headquarters are located in Brisbane, Queensland and we have an international network of regional offices (see locations noted above), the processing of your personal information may involve a transfer outside of the European Economic Area (EEA).

Whenever Tourism and Events Queensland transfers your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

6. HOW TOURISM AND EVENT QUEENSLAND STORES AND SECURES INFORMATION WE COLLECT

Tourism and Events Queensland utilises a combination of industry-standard security technologies, procedures and organisational measures to help protect your personal information from unauthorised access, use or disclosure.

Electronic records of personal information collected by Tourism and Events Queensland are stored in databases that are hosted on servers in Sydney, Australia.

Tourism and Events Queensland also requires its staff to ensure that digital paper records containing personal information are stored securely. Tourism and Events Queensland employees are bound by confidentiality obligations as a condition of their employment, and this extends to ensuring that personal information collected by Tourism and Events Queensland is kept confidential.

When you make a payment through our websites your personal and financial details are protected at all stages of the transaction by powerful encryption technology. Your payment card details are NOT stored on our servers at any stage of the transaction. Once the payment card details have been sent to our financial institution they are no longer known to our system. This ensures that your payment card details are seen only by yourself and the bank performing the transactions.

Tourism and Events Queensland websites contain links to other sites that are external. Tourism and Events Queensland takes care in linking websites but has no direct control over the content of the linked websites, or to the changes that may occur to the content on those sites. It is the responsibility of the user to make their own decisions about the accuracy, currency, reliability and correctness of information contained in linked external websites. Visitors to those websites should refer to their separate privacy policies and practices, e.g. Google Analytics and Adobe packages.

Retention Policy

Personal data that we process for any purpose(s) will not be kept for longer than is necessary for that purpose(s). We will determine the period of retention by taking into consideration the period necessary for retention for its lawful purpose.

Personal data of individuals participating in a Tourism and Events Experience Program will only be kept for a period of 12 months from the date of completion of the Experience Program, unless agreed otherwise.

Personal data of individuals who have subscribed to Tourism and Events Queensland e-newsletters will be kept for the period that the subscriber remains active. Inactive subscriber data will be deleted after 5 years. Please note that Tourism and Events Queensland holds a marketing suppression list (which includes opt-out and inactive subscriber data) to ensure that no further marketing communications are sent to these individuals; Tourism and Events Queensland will not use the data held on this list for any other purpose.

Please note that we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

 

7. HOW TO ACCESS AND CONTROL YOUR INFORMATION

Information Privacy Act

Under the Information Privacy Act, you have the right to seek access to the records of personal information that Tourism and Events Queensland holds about you. You also have the right to ask Tourism and Events Queensland to alter your personal information if you think the information is inaccurate, out-of-date, incomplete or misleading.

Please contact our Privacy Officer (details in Section 8 below) setting out what information you wish to access or correct, your name and a mailing/email address. We may ask you to verify your identity before processing any access or correction requests to make sure that the personal information we hold is properly protected.  Except in the case of more complicated requests, we will endeavour to respond to access and correction requests within 30 days.

If Tourism and Events Queensland refuses to provide you with access to your personal information or to correct that information as you request, we will provide you with reasons for that refusal and information about how to make a complaint.

EU GDPR

Under the GDPR, EU residents have additional rights under the data protection law. Your rights include:

  • the right to be informed;
  • the right to access;
  • the right to rectification;
  • the right to erasure;
  • the right to restrict processing;
  • the right to object to processing;
  • the right to complain to a supervisory authority; and
  • the right to withdraw consent.

Right to be informed

You have the right to confirmation as to whether or not Tourism and Events Queensland processes your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Provided that the rights and freedoms of others are not affected, Tourism and Events Queensland will supply to you a copy of your personal data. The first electronic copy will be provided free of charge, but additional copies in specific formats may be subject to a reasonable fee.

Right to access

You have the right to rectify any inaccurate personal data Tourism and Events Queensland holds about you and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

Tourism and Events Queensland may ask you to verify your identity before processing any access or correction requests to make sure that the personal information we hold is properly protected. 

Right to erasure

In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

Right to restrict processing

In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, Tourism and Events Queensland will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public interest.

Right to object to processing

You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest or in the exercise of any official authority vested in Tourism and Events Queensland; or the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, Tourism and Events Queensland will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims.

You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, Tourism and Events Queensland will cease to process your personal data for this purpose.

You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

Right to complain to a supervisory authority

You have the right to make a complaint at any time to your national data protection authority. However, we request that you please contact Tourism and Events Queensland in the first instance. Contact details for Tourism and Events Queensland’s Data Protection Officer is provided in Section 8 below.

Right to withdraw consent

To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

Privacy Complaints

If you wish to complain about how Tourism and Events Queensland manages personal information, you should submit a written complaint by post or email using the contact details set out in this Policy. Tourism and Events Queensland will endeavour to respond to your complaint within 30 days.

If you are not satisfied with Tourism and Event Queensland’s response you may make a written complaint to the Office of the Information Commissioner Queensland.

Please note that any correspondence received via this website will be treated as a public record and will be retained as required by the Public Records Act 2002 (Qld) and other relevant regulations.
